In support thereof, Petitioner states: 1. **Improper Case Merger**: The child support case currently assigned to Petitioner was improperly merged with a prior case involving another individual. There is documented confusion in the courts records between **Petitioners name** and a **previously suspected fathers name**, resulting in a misassignment of legal responsibility. 2. **Petitioner Was Not Married to the Childs Mother**: Under **Florida Statutes 742.12**, genetic testing must be offered in paternity proceedings when the parents are not married at the time of the childs birth. Petitioner was never married to the mother of the child, and was therefore entitled to paternity testing before any support obligation could be enforced. 3. **No DNA Test Was Conducted**: Petitioner was never served properly or informed of the opportunity to contest paternity, and no DNA test has ever been conducted in this case. As such, there has been no legal confirmation of paternity as required by law. 4. **Violation of Due Process**: The failure to notify Petitioner and provide him with the opportunity to challenge paternity constitutes a **violation of due process**. This omission is particularly egregious given the errors already acknowledged in financial records and enforcement. 5. **Request to Vacate or Stay Enforcement**: Given the improper merger, confusion in identity, and lack of paternity verification, Petitioner respectfully requests that the Court **vacate any and all support orders** associated with the misassigned case, or in the alternative, **stay enforcement** until DNA testing can be completed and legal paternity confirmed or denied. ### **WHEREFORE**, Petitioner respectfully requests that this Honorable Court: A. Order **genetic testing** pursuant to Florida Statutes 742.12; B. **Vacate or stay enforcement** of existing child support orders until paternity can be legally established; C.
